The following document, hereafter referred to as "the agreement", governs any and all use of all object-code libraries, source-code files, documentation and any other related items that comprise the CursesAPI distribution, hereafter referred to as "the software".
Use of the software by any entity is permitted only through unconditional acceptance and compliance of the terms listed in the agreement. Installation and/or use of the software indicates acceptance of the terms listed in the agreement.
There are four different types of licenses, each allowing the licensee different rights to use the software. These are evaluation license, educational license, binary license, and full-source license. All licenses are bound by the terms following the license descriptions.
Use of unregistered software is permitted only through the evaluation license. The evaluation license allows the licensee to install the software and use it to develop applications solely for the purpose of determining the fitness of the software for the licensee's use. By installing the software on a computer system, the person that has authorized the installation becomes the licensee and indicates their acceptance of the terms in this agreement. The evaluation license expires 30 days from the licensee's first use of the software.
No application, library or object code that is compiled or linked with the aid of the software that is used under this license may be sold or otherwise distributed by any means. Upon expiration of the evalution license, the licensee is obligated to remove all portions of the software from all computers that the licensee has installed it on, and must destroy any application, library or object-code that is produced with the software.
The software is offered to students and teaching professionals at a discounted rate. Use of the software under this license is governed by all terms in the Binary License, except as listed here.
No application, library or object code that is compiled or linked with the aid of the software that is used under this license may be sold or otherwise distributed for the purpose of obtaining profit. The software may not be used under this license by any for-profit organization, or on any for-profit organization's products.
The Binary License permits the licensee to use the software to develop applications for general and commercial use.
The Full-Source Code License allows the licensee all priveleges granted by the Binary License. In addition, the source-code for the software will be included.
Source-code is offered for the education of the licensee, and for the purposes of modifying the software for the licensees specialized needs. All source-code and technology within is considered strictly confidential, and remains the sole property of Ingen Software, Ltd. No distribution of the source-code and/or software, in modified or original form, is permitted by any means nor for any reason.
A signed Non-Disclosure Agreement must be on file with Ingen Software, Ltd. before source-code access will be granted to any licensee.
Licenses are granted per author, per machine. Each licensee is allowed to install the software on one (1) machine. Each person that is going to use the software must purchase an appropriate license.
It is forbidden, under any circumstances, to disassemble or reverse-engineer any file that comprises the registered or unregistered versions of this software.
Any redistribution of source-code, object-code, and/or unauthorized applications that have been developed with the software is strictly prohibited, and is in violation of any license granted.
Ingen Software assumes no responsibility for any damages incurred or implied by the installation or use of this software, nor makes any claims to its fitness for any intended purpose. The software is purchased 'as-is'. Ingen Software is not obligated to modify, customize, or correct features and/or components of the software. Upgrades and fixes to the software will be made at Ingen Software's sole discretion, and at times designated solely by Ingen Software.
Upon purchasing a license to use CursesAPI, you will be allowed to upgrade for one (1) year from the date that we receive your order. You will receive email when upgrades are available, along with instructions for downloading your registered upgrade.
We strive to use the Internet to the fullest, and attempt to do as much commerce over the 'net as possible. Registered software and upgrades are offered without media or shipping charges if delivery is made via the Internet. If you desire MS-D*S or UN*X tar formatted 3-1/2" floppy diskettes containing the software, you must enclose an additional $4.95 per floppy to cover media and shipping charges. We reserve the right to change the terms regarding no-charge delivery of software over the Internet.
