License Agreement and Disclaimer


Binding Contract: This is a legally binding contract among you, Block Financial Corporation ("Block") and the Kiplinger Washington Editors, Inc. ("Kiplinger"). It is a complete and exclusive statement of all of the terms of the contract and may not be changed by any oral or written statement, except written agreements signed by Block and Kiplinger. Please read this contract carefully. UTILIZING THIS SOFTWARE MEANS YOU AGREE TO ALL THE TERMS OF THE CONTRACT.


License: You have the right to use Kiplinger TaxCut provided it is installed on only one computer at a time and to make one copy of the software for backup purposes. You may not allow others to use the software or reproduce the software, or disassemble, decompile, or reverse engineer the software. Kiplinger TaxCut is copyrighted and Block and Kiplinger reserve all rights, including the right to duplicate and sell the software.


Limited Warranties:


Refund Guarantee: Block agrees to refund the full purchase price, exclusive of shipping and handling charges, if you are dissatisfied with this software for any reason. Notify Block by calling 1-800-457-9525 within 30 days of receiving this software.


Accuracy of Calculations: If Kiplinger TaxCut makes an arithmetic error that results in your payment of a penalty and/or interest to the U.S. Internal Revenue Service ("IRS"), Block will reimburse you within 90 days after you pay the IRS for the amount of the penalty, plus interest (but only the portion of such interest that does not exceed $10,000) paid by you, and only if you meet all of the following conditions: (1) the penalty and/or interest is for the 1996 tax year; (2) the penalty and/or interest is assessed against you by the IRS and relates solely to an arithmetic error made by Kiplinger TaxCut, and not to an incorrect entry of data, a claim for an improper deduction, a failure to report income, an incorrect interpretation of the law, or any other reason; (3) you were not notified of mistakes in Kiplinger TaxCut in time for you to file an amended return and avoid or reduce the penalty and/or interest; (4) you notified Block at 4435 Main Street, Kansas City, Missouri 64111 as soon as you learned of the mistake (and in no event later than 30 days after the penalty is assessed); (5) your tax return was prepared using the Filing version of Kiplinger TaxCut in accordance with the operating instructions, not the Planning or other versions;  (6) you registered with Block as a user of this 1996 tax year version of TaxCut; (7) the penalty and/or interest pertains only to your personal tax return; and (9) you sent Block complete documentation of the penalty and/or interest, including all correspondence to and from the IRS, a copy of your tax return as filed with the IRS (in paper and electronic media), proof that you paid the penalty and/or interest, and other information Block reasonably requested.


These warranties give you specific legal rights, and you may also have other rights which vary from state to state.


Exclusion of Other Warranties: Except for the limited warranties described above and subject to contrary provisions of state law, Kiplinger TaxCut is sold "AS IS" and Block and Kiplinger make no warranties, express or implied, regarding Kiplinger TaxCut. Without limiting the preceding sentence and to the maximum extent permitted by applicable law, you agree that ANY IMPLIED WARRANTIES SUCH AS THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE EXCLUDED from your purchase and use of Kiplinger TaxCut. We do not promise that Kiplinger TaxCut will find all of the deductions you are entitled to, that you will report all of the income you are required to report, or that the program is free from bugs or errors; nor do we make any other promises about the performance, accuracy, or reliability of Kiplinger TaxCut. Some states do not allow the exclusion of implied warranties, so these exclusions may not apply to you.


Limitation on Damages: If you satisfy the conditions described above, Block will refund your purchase price, exclusive of shipping and handling charges, and Block will reimburse you for IRS penalties and/or interest you incur solely as a result of arithmetic mistakes by Kiplinger TaxCut. Subject to contrary state law, these are the only damages that you can be entitled to. In no event will Block, Kiplinger or their suppliers, dealers, or distributors be liable for any indirect, special, incidental, or consequential damages such as lost profits or investment, even if Block and/or Kiplinger has been advised of the possibility of such damages. You agree that the essential purposes of the contract can be fulfilled without these excluded damages. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.


Governing Law: This contract is governed by the law of Missouri.
