Limited Warranty

Media.  Novell warrants the physical media of the software and documentation 
You have acquired (referred to in this limited warranty as the "Software") against 
physical defects for a period of 90 days from installation or purchase, whichever 
is later.  Your sole remedy for defective media is replacement.

Software.  THE SOFTWARE IS PROVIDED AS IS AND WITHOUT ANY WARRANTIES OF ANY KIND, 
INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR 
PURPOSE, MERCHANTABILITY OR NONINFRINGEMENT.

THE SOFTWARE IS NOT DESIGNED, MANUFACTURED OR INTENDED FOR USE OR RESALE FOR ON-LINE 
CONTROL EQUIPMENT IN HAZARDOUS ENVIRONMENTS REQUIRING FAIL-SAFE PERFORMANCE, SUCH AS 
IN THE OPERATION OF NUCLEAR FACILITIES, AIRCRAFT NAVIGATION OR AIRCRAFT COMMUNICATION 
SYSTEMS, AIR TRAFFIC CONTROL, DIRECT LIFE SUPPORT MACHINES, OR WEAPONS SYSTEMS, IN 
WHICH FAILURE OF THE SOFTWARE COULD LEAD DIRECTLY TO DEATH, PERSONAL INJURY, OR SEVERE 
PHYSICAL OR ENVIRONMENT DAMAGE.

Disclaimer.  EXCEPT AS OTHERWISE RESTRICTED BY LAW, NEITHER NOVELL NOR ITS LICENSORS 
MAKES ANY WARRANTY, REPRESENTATION OR PROMISE NOT EXPRESSLY SET FORTH IN THIS LIMITED 
WARRANTY.  NOVELL AND ITS LICENSORS DISCLAIM AND EXCLUDE ANY AND ALL IMPLIED WARRANTIES 
OF MERCHANTABILITY, TITLE OR FITNESS FOR A PARTICULAR PURPOSE.  NEITHER NOVELL NOR ITS 
LICENSORS WARRANTS THAT THE SOFTWARE WILL SATISFY YOUR REQUIREMENTS OR THAT THE SOFTWARE 
IS WITHOUT DEFECT OR ERROR OR THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED.  
Some states do not allow limitations on how long an implied warranty lasts, so the above 
limitation may not apply to You.  This warranty gives You specific legal rights which 
vary from state to state.

Limitation of Liability.  EXCEPT AS OTHERWISE RESTRICTED BY LAW, THE AGGREGATE LIABILITY 
OF NOVELL AND ITS LICENSORS ARISING FROM OR RELATING TO YOUR USE OF THE SOFTWARE OR ANY 
SERVICES PROVIDED BY NOVELL AND/OR ITS AGENTS AND LICENSORS IS LIMITED TO THE TOTAL OF ALL 
PAYMENTS MADE BY OR FOR YOU FOR THE SOFTWARE.  NEITHER NOVELL NOR ITS LICENSORS, EMPLOYEES, 
OR AGENTS SHALL IN ANY CASE BE LIABLE FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, INDIRECT 
OR PUNITIVE DAMAGES EVEN IF ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.  NEITHER NOVELL 
NOR ITS LICENSORS, EMPLOYEES, OR AGENTS IS RESPONSIBLE FOR LOST PROFITS OR REVENUE, LOSS OF 
USE OF SOFTWARE, LOSS OF DATA, COSTS OF RE-CREATING LOST DATA, THE COST OF ANY SUBSTITUTE 
EQUIPMENT OR PROGRAM.  Some states do not allow the exclusion or limitation of incidental 
or consequential damages, so the above limitation or exclusion may not apply to You.

OpenDoc for Windows Pre-Release Software Developer Kit License

The software and accompanying documentation ("Software") You have acquired are protected by 
the copyright laws of the United States and international copyright treaties.  The Software 
contains third party programs distributed to You by Novell under license, such as SOMobjects* 
Toolkit Version 2.1 for Windows (32-bit support).  The possession and use of the Software is 
subject to the restrictions contained in this License.

License.  Subject to the terms and conditions of this License, Novell grants to You a 
non-exclusive, non-transferrable right to use the Software solely (i) for evaluation purposes,
and (ii) to perform integration and compatibility testing with Your program that runs on or
in conjunction with the OpenDoc for Windows technology.  You may not use the Software in 
any manner which is not directly related to the evaluation and testing activities stated 
herein.  Use of the Software for any purpose outside the scope of this license, without prior 
written permission from Novell, shall be considered a material breach of this License.  Nothing
herein shall be construed as expressly or impliedly granting any license for or right to any 
patents, copyrights, or other ideas made, conceived, acquired, or owned by Novell or its licensors.

You may make one copy of the Software for each employee who is involved in the evaluation and
testing process described herein, provided that each copy contains all copyright notices and
other proprietary legends that were in the original copy.  No license is herein granted, by 
implication or otherwise, to modify, reverse engineer, disassemble, decompile, or reverse 
translate any part of the Software. Novell and its licensors reserve all rights not expressly 
granted to You.

Support.  Novell will have no obligation to provide technical support, updates or upgrades to You.

Ownership. The Software, and all copies thereof, are the sole and exclusive property of Novell
and/or its licensors.  You shall not mortgage, pledge, sell, transfer, assign, loan, rent,
lease, distribute or create derivative works based upon the Software.

Pre-release version. The Software is a pre-release version which is still in testing and has 
not reached a level of accuracy, stability, and performance of a generally available release.  
Particularly when such software enters divergent working environments and is used in many 
customized applications, errors and bugs may surface that earlier testing did not reveal.
The Software may be substantially modified prior to commercial or general release, and APIs 
or other specifications may not be accurate or may change prior to such release.  Novell 
cautions You to determine for Yourself the suitability of the use of the Software for any 
purpose. You acknowledge that neither Novell nor its licensors has any express or implied 
obligation to announce, introduce or market the Software or any associated product.

General Terms

Term.  You may use and retain the Software only until Novell makes the final version generally 
available.  This agreement shall terminate immediately without notice from Novell if You fail 
to comply with any provision herein.

Governing Law.  Except as otherwise restricted by law, this License shall be governed 
by, and interpreted in accordance with, the laws of the State of Utah of the United States 
of America, without regard to laws of Utah governing conflicts of law.  Furthermore, it is 
understood that this License shall be treated as though it were executed in Utah County of 
the State of Utah.  The parties agree that any action relating to this License shall be 
instituted and prosecuted in the courts of competent jurisdiction of the State of Utah.

Entire License.  This License sets forth the entire understanding and License between You 
and Novell and may be amended only in a writing signed by both parties.  NO VENDOR, DISTRIBUTOR, 
DEALER, RETAILER, SALES PERSON OR OTHER PERSON IS AUTHORIZED TO MODIFY THIS LICENSE OR 
TO MAKE ANY WARRANTY, REPRESENTATION OR PROMISE WHICH IS DIFFERENT THAN, OR IN ADDITION 
TO, THE REPRESENTATIONS OR PROMISES OF THIS LICENSE.

Waiver.  No waiver of any right under this License shall be effective unless in writing, 
signed by a duly authorized representative of the party to be bound.  No waiver of any 
past or present right arising from any breach or failure to perform shall be deemed to 
be a waiver of any future right arising under this License.

Severability.  If any provision in this License is invalid or unenforceable, that provision 
shall be construed, limited, modified or, if necessary, severed, to the extent necessary, 
to eliminate its invalidity or unenforceability, and the other provisions of this License 
shall remain unaffected.

Export.  Regardless of any disclosure made by You to Novell of an ultimate destination of the
Software, You will not export or transfer, whether directly or indirectly, the Software, or
any portion thereof, or any system containing such Software or portion thereof, to anyone 
outside the United States without first complying strictly and fully with all export controls 
that may be imposed on the Software by the United States Government or any country or organization 
of nations within whose jurisdiction You operate or do business.

U.S. Government Restricted Rights.  Use, duplication, or disclosure by the United States 
Government is subject to restrictions as set forth in FAR  52.227-14 (June 1987) Alternate 
III(g)(3) (June 1987), FAR  52.227-19 (June 1987), or DFARS  52.227-7013 (c)(1)(ii) (June
